Please read the following terms and conditions carefully before submitting entries into the film competition and agree to them by ticking the box on the registration form. If you require further clarification, please email film@egeh.org.

ELIGIBILITY: The English Gambling Education Hub Film Competition (the "Competition") is open to any organisation based in the UK that is working with young people aged between 11 and 25 years old at the date of entry.

ORGANISER: The Competition is being funded by GambleAware as part of the English Gambling Education Hub. GambleAware is a charity and company registered in England and Wales with charity number 1093910 and company number 4384279. The Competition is being run by the Young Gamers and Gamblers Education Trust, known as Ygam, a charity and company registered in England and Wales whose registered address is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ and whose company number is 09189998 and whose charity number is 1162425 ("Ygam"). Ygam runs the English Gambling Education Hub with GamCare.

ENTRY PERIOD: The Competition begins at 9:00 am UK time 23rd October 2023 and ends at midnight UK time on the 12th July 2024. Entries submitted before or after this entry period will not be eligible.

HOW TO ENTER: To submit a valid entry, the entry must comply with the entry criteria which can be found on the portal, in the toolkit, and as part of registration and submission forms.

ENTRY LIMIT: Entrants may enter as many times as they wish, but may only apply for one grant per organisation.

ORIGINAL WORK: All entries must be original, unpublished works created by young people who, at the time of entry, are within the age bracket set out in the 'Eligibility' section above and who are registered with, regularly attend or are members of the entrant organisation. The entrant and/or the young people involved in the entry must own all rights to the work.

PERMISSIONS: The entrant must have obtained the consent of a parent or guardian over 18 for all any persons under the age of 18 who are involved in their entry. Entrants agree to provide evidence of this consent on request if Ygam requests it. Ygam may refuse entry or to choose another winner if such evidence, where requested, has not been given.

RIGHTS: By entering the Competition, the entrant and all young people involved in their entry grant GambleAware a royalty-free, perpetual, non-exclusive, transferable, sub-licensable licence to use, reproduce, distribute, and display their entered film for any purpose, in any media now known or later developed. The entrant and all young people involved in their entry also grant GambleAware a royalty-free, perpetual, non-exclusive, transferable, sub-licensable licence to use, edit and amend the dialogue, music, sounds and/or story used in their entry for the purpose of professionally remaking the winning entry. For the avoidance of doubt, GambleAware shall own the professionally remade version.

AWARD: The winner will be selected by a panel of judges and will receive the award set out in the competition details (see toolkit). The award is non-transferable and cannot be exchanged for cash. Ygam and GambleAware accept no responsibility for any costs or expenses incurred by the winner, the young people involved in their entry or their parents/guardians in connection with attending any part of their award (including travel to and from any filming). Any commitment to allow the entrant and the young people involved in their entry access to the filming of the professionally remade version of their entry is subject to availability and subject to finding a mutually acceptable date. If no such date can be found, the filming will take place regardless and the entrant and the young people involved shall forfeit that part of the award.

JUDGING: The winner will be selected based on the criteria set out in the competition details. The judges' decision is final. Ygam will not enter into any correspondence or discussion with entrants regarding the judges' decision.

WINNER NOTIFICATION: Winners will be notified by email within 2 weeks of the stated judgment period. If a winner cannot be contacted or fails to respond within the specified time frame, we reserve the right to select an alternate winner.

COMMITMENTS: By entering the competition entrants promise that all information they submit is correct, not obscene or offensive, and that they will not do anything that could damage or harm the reputation of the English Gambling Education Hub or Ygam.

DISQUALIFICATION: Ygam may disqualify any entrant (including the winner) from the competition if it believes (in its sole and absolute discretion) that such entrant has breached any of these terms or the competition details. Where the disqualified entrant is the winner, Ygam may choose an alternate winner.

PRIVACY: Any personal information submitted as part of the Competition will be processed in accordance with Ygam's privacy policy which can be found here. Entrants must have obtained all required consents and permissions for any personal information that they provide to Ygam as part of the Competition.

PROMOTION: The winning entrant may be asked by Ygam to take part in promotional activities to promote their success in the Competition. Where this request is made, the entrant agrees that Ygam may use their name and logo to publicise their winning entry and they agree to use their reasonable endeavours to take part in such publicity. They also agree to work with Ygam in good faith to assist Ygam in obtaining the required consents and permissions to enable any young people involved in their entry to also take part in any publicity.

DISCLAIMER: Ygam accepts no responsibility for entries that do not meet the entry requirements, are incomplete or are received before or after the entry period set out above. To the extent permissible under applicable law, Ygam shall not be liable to any entrant or any young people involved in their entry for any loss or damage howsoever caused (whether in contract, tort (including, without limitation, negligence) statutory duty or otherwise) arising out of or in connection with the Competition or arising out of or in connection with them winning the Competition.

INDEMNIFICATION: By entering the Competition, entrants agree to indemnify, defend, and hold harmless Ygam and its employees, directors and officers from and against any and all claims, losses, expenses or damages of any kind arising out of their participation in the Competition or arising out of them winning the Competition.

GOVERNING LAW: These terms and conditions are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.

ACCEPTANCE OF RULES: Participation in the Competition constitutes the entrant's full and unconditional agreement to and acceptance of these terms and conditions and by entering the entrant confirms that all young people involved in their entry have agreed to be bound by these terms and conditions or, where they cannot legally do this, their parents or guardian have agreed to be bound by these terms and conditions on their behalf.

These terms and conditions ("Terms") govern the £250 grant ("Grant") offered by Ygam ("we", "us", "our") for prospective participants ("you", "your") in the English Gambling Education Hub Film Competition ("Competition").

By applying for a Grant, you agree to abide by these Terms. Failure to comply may result in disqualification from the Competition and a requirement to refund the Grant amount.

ELIGIBILITY: To be eligible for a grant, you must be an organisation based in England that is working with young people aged between 11 and 25 years old at the date of application and you must submit an entry to the Competition by the submission date (see website for details). If you do not submit an entry to the Competition by the submission date you must return the Grant monies to us by bank transfer within 5 days of our request for the Grant monies to be returned to us.

FUNDING: You are required to submit a budget with your Grant application detailing how the Grant will be spent. The Grant must be spent in accordance with this budget unless we give our written permission for it to be spent otherwise than in accordance with this budget. All Grant monies must be used exclusively for costs directly related to the Competition.

Ygam runs the English Gambling Education Hub in partnership with GamCare.

APPLYING FOR A GRANT: To apply for a Grant, you must complete the online Grant application form in accordance with any instructions provided by us by the deadline specified by us (see website for details). Applications submitted after the deadline will not be eligible. Each organisation may only submit one application for a Grant.

REPORTING: You must keep true, complete, separate, and accurate records of all Grant monies spent including all invoices, receipts, and accounts and you must make such records available to us on our request.

PAYMENT OF THE GRANT: You will receive written confirmation that you have been successful within 5 workings days of submission of application. You will be sent a bank form to complete and return. Subject to the necessary funds being available when payment falls due, we will pay the Grant to you within 14 days of the date of receiving the completed bank form. You acknowledge and accept that payment of the Grant can only be made to the extent that we have available funds and if applicable, have received the funds from the relevant third party. Subject to these Terms, we shall pay the Grant to you by electronic transfer to your ordinary business bank account that must be in your name. The bank account details must be provided to us before any payment can be made. You agree that you are solely responsible for any error in the bank details provided to us. The Grant amount shall not be increased for any reason, including where there is an increase in inflation or you experience an increase in costs. You agree to promptly repay to us any money incorrectly paid to you either as a result of an administrative error or otherwise.

VAT: You agree that the Grant is not in exchange for any goods or services and is not subject to VAT or any other equivalent sales or goods tax. However, in the event that HMRC takes the view that the Grant is within the scope of VAT, and VAT should have been collected and accounted for, then you and us agree that the Grant was made on a VAT inclusive basis. Therefore, you shall be responsible for paying any VAT that may become due, to HMRC.

REPAYMENT: If you fail to comply with these Terms, fail to submit a Competition entry within the timescales set out in these Terms, or are disqualified from the Competition for any reason, the Grant must be repaid in full by electronic transfer to our bank account within 5 days of our request for the Grant monies to be returned. Where the whole of the Grant monies have not been spent by the date of your Competition submission, you must notify us of the amount that has not been spent and return this underspend to us by electronic transfer to our bank account within 5 days of our request for amount of the underspend to be returned to us.

WARRANTIES: You warrant, represent and undertake that you have full power and authority to enter into these Terms and apply for and receive the Grant and that all necessary approvals and consents have been obtained and are in full force and effect; that the execution of these Terms does not and will not contravene or conflict with your governing documents or any legal obligations to which you are subject; that you are financially solvent; that all information provided to us is to the best of its knowledge, complete and accurate; and that you shall at all times comply with all relevant legislation and all applicable codes of practice and other similar codes or recommendations, and shall notify us immediately of any significant departure from such legislation, codes or recommendations.

LIMITATION OF LIABILITY: We accept no liability for any consequences, whether direct or indirect, that may result from your participation in the Competition or your use of the Grant or the withdrawal of the Grant. Subject to these Terms, our total liability to you under these Terms is limited to Grant amount. You shall indemnify and hold us, our employees, agents, officers and sub-contractors harmless with respect to all claims, demands, actions, costs, expenses, losses, damages and all other liabilities arising from or incurred by reason of your actions and/or omissions under these Terms or by your obligations to third parties.

PRIVACY: Any personal information submitted as part of your Grant application will be processed in accordance with our privacy policy which can be found here. You must have obtained all required consents and permissions for any personal information that you provide to us as part of your Grant application.

GOVERNING LAW: These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales
